Antar takes BetMGM case to Court of Appeals

Sam A Antar continues to fight his legal fight against online gambling operator BetMGM. After a New Jersey District Court judge tossed the case earlier this year, Antar has filed with the Third Circuit Court of Appeals.

Judge Madeline Cox Arleo concluded that the state’s Consumer Fraud Act (CFA) did not apply in this case, as the prevailing law overseeing the casino industry is the New Jersey Casino Control Act (CCA). Additionally, she said the casinos in the state have no obligation to stop problem gamblers from wagering with money they don’t have.

Antar alleged that Borgata Casino and BetMGM solicited him to play on the company’s online casino sites despite the VIP hosts allegedly being aware he was a problem gambler. He claims he wagered almost $30 million across 2019 and 2020. He named VIP Account Managers Quinton Hogan and Jerry Liang in the complaint, saying they plied him with bonuses and encouraged him to keep depositing on the site despite several “fundamental and visible sy..

Armenia to harmonise tax charges on gambling winnings

Armenia continues to modify its gambling regime, as Parliament has approved a package of new amendments to rectify existing laws related to gambling.

Approved on Wednesday, 12 June, legislative changes will introduce new tax charges on ‘gambling winnings’, categorised as “large win” and “regular win” for customers.

A “large win” is defined as any single win exceeding 5 million drams (approximately €11,000), which will be subject to a 5% income tax, sanctioned as a measure intended to ensure that significant gambling profits are ‘adequately taxed’.

For smaller wins, consumers will be required to calculate the net winnings, as the difference between the total winnings and the bets placed. The ‘net win amount’ will then be subjected to a 10% income tax.

The distinction aims to simplify the taxation process for frequent, smaller wins, and ensure that gamblers pay their fair share based on actual profits.

The changes mark a shift in Armenia’s approach to gambling taxation. Previously, ..

GamCare: Banks are the frontline to prevent gambling-related financial harms

GamCare has issued new guidance to British banks on how to spot and prevent gambling-related financial harms impacting their clients’ businesses.

The problem-gambling treatment support charity has published its “Business banking, debt and gambling harm” report, produced from insights gained from workshops and research on gambling-related financial harms.

The report emphasizes the importance of raising awareness and training staff within the banking sector. Banks should utilise their vast data resources to better understand the scale of gambling harm across business accounts and analyse how to foresee and prevent such financial issues.

Another key recommendation is the blocking of gambling transactions on business accounts. The report highlights that while only a small number of business bank account providers, such as Monzo and Tide, currently block gambling transactions by default, and some others, like Santander and NatWest, offer an opt-in gambling block at the customer’s request..

SkyCity Adelaide casino licence suitability investigation to be resumed

An independent review into the suitability of SkyCity Adelaide to hold a casino licence will soon be resumed by the Honourable Brian Martin AO KC.

The resumption of the investigation follows the conclusion of the casino’s proceedings with the Australian Transaction Reports and Analysis Centre for its breaches of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.

Investigations into SkyCity Adelaide began in July 2022, after Consumer and Business Services, the South Australia gambling regulator, appointed Martin to conduct an independent review under section 22(2) of the Casino Act 1997 (SA) regarding “the suitability of SkyCity Adelaide to continue to hold the SkyCity Adelaide casino licence and the suitability of SkyCity to continue to be a close associate of SkyCity Adelaide”.

However, in February 2023, the investigation was put on hold as Martin advised former Liquor and Gambling Commissioner Dini Soulio that he was unable to determine the question of whether the..

Weerwind out of Dutch politics as new coalition takes charge of KOA reforms

The formation of a new four-party coalition government in the Netherlands has brought sweeping changes across government departments.

As expected the change sees Franc Weerwind removed from his position as Minister of Legal Protections, overseeing the regulatory reform of Dutch gambling under the laws of the Remote Gambling Act (KOA).

Engaged in six months of negotiations, the Party for Freedom (PPV) led by populist Geert Wilders, secured its majority in the Kamer, ending the Netherlands political stalemate by agreeing governing terms with conservative counterparts the Party for Freedom and Democracy (VVD), the New Social Contract Party (NSC) and the Farmer-Citizen Movement (BBB).

A fragile ‘conservative alliance’ has been established on the condition that Wilders will not serve as Prime Minister with the seat reserved for ‘Wilders-endorsed’, non-populist Dick Scoof – who ends PM Mark Rutte’s 14-year premiership as Dutch PM.

With the leadership agreement settled, the four parti..

KSA fines LCS and Blue High House for repeat offences

Kansspelautoriteit, the Dutch Gambling Authority, has issued fines to LCS Limited and Blue High House for operating illegally in the Netherlands.

LCS Limited was handed a penalty fee of €2.07m in October 2023 having been found to offer Dutch players illegal games of chance via its Sons of Slots online casino brand in 2022.

However, the KSA found LCS Limited to have still been operating illegally in the Dutch market through another online casino brand, Yugibet. As a result, LCS has been handed a €165,000 penalty on top of the initial €2.07m fee.

Around the same time in October 2023, Panama-registered operator Blue High House was imposed a cease and desist order subject to penalty for offering illegal games of chance via Concrete Line, one of its online casino websites.

The KSA claims that these breaches have not ceased and has handed the operator a €129,000 fine while suggesting that another fine “may also be imposed”.

René Jansen, Chairman of the KSA: “An order subject to a p..
